The agreement between you and WMFNTK

Please read these terms carefully before using WMFNTK. By creating an account or using the service, you agree to be bound by these terms. If you do not agree, do not use the service.
WMFNTK, LLC ("WMFNTK," "we," "us," or "our") provides a secure web application that allows individuals to organize, store, and selectively share important personal and family information — including documents, account details, legal records, and related data — with trusted designated contacts called LifeProxies℠.
The service is available at app.wmfntk.com and is operated from the United States.
You must be at least 18 years old to use WMFNTK. By creating an account, you represent that you meet this requirement and that all information you provide is accurate and complete. The service is intended for personal use and is not designed for commercial resale or redistribution.
To use the service, you must create an account with a valid email address and phone number. You are responsible for:
You may not share your account with others or create accounts on behalf of third parties without their consent.
WMFNTK is a paid service billed annually. We currently offer:
Prices are in US dollars. All payments are processed by Stripe.
Your subscription begins on the date you complete checkout and renews automatically on the same date each year unless you cancel before the renewal date.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you will retain full access until that date. We do not offer refunds for unused portions of a subscription period.
We may change subscription prices with at least 30 days' notice. Price changes will not affect your current billing period and will apply at your next renewal.
If a payment fails, we will notify you by email. Continued failure to pay may result in suspension or termination of your account.
The LifeProxy℠ feature allows you to designate trusted individuals ("LifeProxies℠") to access some or all of your LifeBytes℠ under conditions you define.
Important: WMFNTK is an organizational tool. Designating a LifeProxy℠ does not constitute a legal power of attorney, executor appointment, or any other legally recognized instrument. For legal matters, consult a licensed attorney.
WMFNTK helps you organize and store information. We do not provide legal, financial, tax, or estate planning advice. Nothing in the service or on our website constitutes legal advice. We strongly recommend consulting a licensed attorney or estate planner for legal matters including wills, powers of attorney, trusts, and estate administration.
You own all content you create and store in WMFNTK — your LifeBytes℠, notes, uploaded files, and addresses. By using the service, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the service to you.

We do not claim ownership of your content, and we do not use your content for any purpose beyond operating the service.

The Family plan allows a primary account holder to invite additional household members. Each invited member:
The primary account holder is responsible for the subscription and for ensuring that invited members comply with these Terms.
We aim to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance, updates, or emergency downtime. We will provide advance notice of planned maintenance when possible.
We are not liable for any loss or inconvenience caused by temporary unavailability of the service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WMFNTK DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the service will be error-free, that data will never be lost, or that the service will meet every specific requirement you may have.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WMFNTK, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOSS OF REVENUE, OR HARM ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless WMFNTK, LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service, your content, or your violation of these Terms.
We may suspend or terminate your account if you materially breach these Terms and do not cure the breach within 10 days of written notice, or immediately if the breach is not capable of being cured.
You may terminate your account at any time by deleting it from your account settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction in the State of Delaware.
We may update these Terms from time to time. If we make material changes, we will notify you by email or by displaying a prominent notice in the application at least 14 days before the changes take effect. Your continued use of the service after that date constitutes acceptance of the revised Terms.
